Police Station Advice and Assistance
The words of the police caution,
"You do not have to say anything but it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence",
will sound familiar to most people but what does it really mean?
Being arrested is a frightening prospect and the police are often given extensive powers in the course of investigating any criminal offence including:
- Denying the right to make a phone call to let someone know that you have been arrested
- Taking an non-intimate sample for example a finger print or a handwriting sample
- Taking an intimate sample for example a penial or saliva swab
- Conducting a search both over and under clothing including a strip search
- Detaining an indvidual for longer than the normal 24 hours without charge
We strongly advise that anyone who is arrested or whose attendance is sought at a police station for a criminal allegation seeks early legal advice. H.P. Gower Police Station Solicitors are available to attend police stations 24 hours a day, 7 days a week both in and outside of Greater London.
As soon as we are told that you have been arrested we will ensure that we call the Police Station where you are detained to speak to you; ensure that your rights are being complied with and tell you when you are likely to be interviewed. We will attend any London Police Station within London to provide you with face to face advice and assistance within 45 minutes of being told that the police are ready to interview you. Wherever you may be arrested in the UK we can arrange for a local specialist to attend the police station on our behalf. We can also arrange to attend the police station with you when your attendance is voluntary.
All persons have the legal right to seek advice from an independent solicitor whilst detained at the police station.
